Character and Fitness Review: What Foreign Students Should Know

For foreign-trained students preparing for the bar exam, character and fitness review can raise questions that are different from those faced by domestic applicants. The process generally focuses on honesty, completeness, and the applicant's ability to document their history across countries and jurisdictions.

Key preparation steps

  • Begin early: request police certificates, court records, employment confirmations, and school records from every relevant country.

  • Disclose carefully: omissions and inconsistencies can create more concern than an explainable past issue.

  • Plan for translations: confirm whether documents must be translated, certified, or accompanied by an affidavit. and/or an Apostille.

Requirements vary by jurisdiction, so applicants should consult the relevant bar admissions authority and keep a timeline of every request and response. Preparing a clear explanation for any gap, disciplinary matter, or foreign legal issue can make the review more manageable.

Some jurisdictions may require the submission of a Good Moral Character and Fitness Certificate signed by one or more attorneys licensed in the U.S.  Foreign-trained students may have little or no exposure to the U.S. legal network. If so, they may find a valuable resource in those licensed attorneys who teach in the LL.M Program.
